市區重建策略檢討〔民間白皮書〕之現有條文及實施檢討（H15關注組製作） | Just another WordPress.com site 市區重建策略檢討〔民間白皮書〕之現有條文及實施檢討（H15關注組製作） Just another WordPress.com site 主頁 H15關注組簡介 民間白皮書前言 《市區重建局條例》和《市區重建策略》 01 八月 2010 發表留言 by 影行者 in 市區重建相關法例釋義 標籤： 4R , 重建項目 , 市區重建策略 , 市區重建局條例 2000年7 月，立法會通過《市區重建局條例》，翌年成立了市建局。市建局是一個公營機構（即不是政府部門），日常營運需自負盈虧。它的工作主要包括4Rs ，即「重建發展（Redevelopment ）、 樓宇復修（Rehabilitation ）、文物保育（pReservation ）及舊區活化（Revitalisation ）」。政府在市建局成立首五年合共注資 100 億元，而市建局的重建項目亦可免補地價，粗略估計，涉及公帑數百億元（20 年內225 個項目）。 政府賦予市建局一系列的責任與權力，市建局的實務工作必須遵照《市區重建策略》的原則和指引來執行。 根據《市區重建局條例》，規定局長（即現今發展局局長）在《市區重建策略》定案前，須進行公眾諮詢。不過，首份《市區重建策略》的公眾諮詢，竟然在短短約兩個月內完成，於2001 年11 月定案，影響著未來20 年225 個重建項目。 政府還賦予市建局很大的權力，如《市區重建局條例》第20條(2)及(3)段指出，局長（即現今發展局局長）在修改或修訂該策略前，如認為該等修改或修訂的性質是「屬輕微、技術性或微不足道的，則無需諮詢公眾。」還有，「局長如認為披露某項資料並不符合公眾利益，則無需披露該項資料」。 《收回土地條例》 01 八月 2010 發表留言 by 影行者 in 市區重建相關法例釋義 標籤： 公共權力 , 市區重建策略 , 收回土地條例 政府立法當年打著「以人為本」和「公共用途」的大原則，說服立法會賦予它一個非常大的公共權力：《收回土地條例》，當市建局無法說服重建區業主放棄其持有物業時，便可引用《收回土地條例...
