Consensul format astfel are o existență dinamică, se negociază și renegociază continuu. Orice constituție fixează numai un anumit moment al procesului. Dar ce este sau nu este constituțional, adică întemeiat pe voința clasei conducătoare, nu depinde de textul unor „legi fundamentale”. Aceasta se poate constata urmărind jurisprudența curților constituționale, instituții politico-juridice care arbitrează diferendele majore, apărând consensul menționat mai sus de eventualele tulburări pe care le pot ocaziona disputele între agenții politici relevanți.
