Dyrektor Krajowej Informacji Skarbowej (KIS) stwierdził, że Spółka nie może zaliczyć do kosztów uzyskania przychodów wydatków ponoszonych na spotkania integracyjne w zakresie dotyczącym Współpracowników, tj. osób fizycznych prowadzących działalność gospodarczą, z którymi Spółka ma zawarte kontrakty B2B i które świadczą usługi o charakterze informatycznym oraz uczestniczą w realizacji projektów na rzecz Spółki, ponieważ wydatki te stanowią wydatki na reprezentację, a ich głównym celem jest tworzenie lub poprawa wizerunku przedsiębiorcy wobec osób trzecich, niebędących pracownikami Wnioskodawcy. Zatem ww. wydatki zostały wyłączone z kosztów podatkowych na podstawie art. 16 ust. 1 pkt 28 ustawy o podatku dochodowym od osób prawnych.
